STATUTE OF “ZACHĘTA” NATIONAL GALLERY OF ART
Section I
Basic Resolutions
§ 1.
„Zachęta” – National Gallery of Art, referred to further as “Zachęta”, is a cultural institution created by an order of the Ministry of Culture on 17th December 1949 as part of the formation by the State of the Central Bureau of Artistic Exhibitions and the attributing thereto the name the “Central Bureau of Artistic Exhibitions” (Diary of Proceedings of the Ministry of Culture and Art from 1950, No. 1, pos. 5) and runs on the basis of the regulation of 25th October 1991 on the organizing and implementing of cultural activities ” (Diary of Proceedings of the Ministry of Culture and Art from 2001, No. 13, pos. 123, and from 2002 No. 41, pos. 364) and on that of the current statute.
§ 2.
1. The geographical scope of the activity of “Zachęta” covers both the Republic of Poland and abroad.
2. The headquarters of “Zachęta” is in Warszawa.
§ 3.
The organizer of “Zachęty” is the Minister of Culture.
§ 4.
“Zachęta” has the authority to use a stamp with the insignia of the Republic of Poland in the centre and surrounding it the text: ZACHĘTA – National Gallery of Art.
Section II
The Goals and Tasks of “Zachęta”
§ 5.
The aim of “Zachęta’s” activity is the promotion of the fine arts.
§ 6.
1. “Zachęta’s” basic tasks are:
1) the preparation of a programme for the promotion of contemporary art;
2) the exchanging of exhibitions and collaborating with other art galleries;
3) the production of publications in the field of the fine arts;
4) the collection and making available of documentation and information on contemporary art;
5) the realisation of education activities;
6) the collection, inventory and preservation of works of contemporary art;
7) collaboration with cultural institutions and associations active in the field of the fine arts and other social organisations;
8) artistic advice and provision of services in the field of exhibition production and education activities.
2. The Programme of “Zachęta’s” activity is confirmed by the Minister of Culture.
Section III
Management and Advisory Structures
§ 7.
1. “Zachęta” is managed by a director appointed and dismissed by the Minister of Culture on consultation with associations of creators in the field of the fine arts.
2. Vice-directors and the chief accountant are appointed and dismissed by the director of “Zachęta”.
3. The director of “Zachęta” manages the institution and is its representative to the outside world.
§ 8.
1. A Programme Committee functions in “Zachęta” as an advisory organ to the director.
2. The director of “Zachęta” sets the regulations of the Programme Committee and decides on its composition.
Section IV
Organisation
§ 9.
The organisation of “Zachęta” is decided by the organising regulations fixed by the director, on the basis of the opinions of the union organisations and creators’ associations active within it.
Section V
Means of Raising Finances and Economic Principles
§ 10.
“Zachęta” is economically active on the bases determined in articles 27, 28 and 29 on the organising and running of cultural institutions.
§ 11.
1. “Zachęta” receives an annual income from the state budget, makes use of incomes raised through “Zachęta’s” own business activity and may also receive financing from physical and legal individuals and other sources.
2. The incomes raised by “Zachęta” are to be used for the covering of running costs and investments.
§ 12.
“Zachęta” pursues business interests in the aim of realising its statutory tasks.
§ 13.
The director of “Zachęta” assures the punctual completion of the annual financial report, its obligatory checking by an auditor and its submission for confirmation to the Minister of Culture.
Section VI
Concluding Principles
§ 14.
Changes to the statute are possible if in accordance with the conventions for its bestowal.
